It’s a never ending battle here in Canandaigua, I need to know how many Locals in NYS have references to Rules and Regulations (Policies) in their current CBA. In PERB’s last decision against us, PERB raised the question to suggest that any contracts that reference the existence of Rules and Regulations could be interpreted as a waiver of the right to negotiate over who does  work that had been exclusively performed by career firefighters. The City wasn’t smart enough to come up with this defense, but PERB has really put us in a bad position now and could have an effect on all Local’s with this language in their CBA.
